These terms and conditions outline the rules and regulations for the use of CC Athletics’ Website, located at https://ccathletics.com.
They also apply to purchases of our products and to ForceMate Cloud, the cloud service included with them (see ForceMate Cloud).
You accept these terms and conditions when you place an order, accept a quote that refers to them, or create an organisation in ForceMate Cloud. The sections on cookies, licence and user-generated content also apply when you use this website.

Purchases
If you wish to purchase any product or service through CC Athletics, you may be asked to supply information such as your credit card number, expiration date, billing address, and shipping information — which will be used to fulfill orders.
ForceMate Cloud
ForceMate Cloud is the cloud service that comes with our products. These trading conditions are the agreement between CC Athletics ApS and the customer for ForceMate Cloud. The customer is the organisation, or the individual coach, that uses ForceMate Cloud.
-
Who can accept. The person who creates an organisation in ForceMate Cloud must be 18 or older and authorised to accept these trading conditions and the DPA on behalf of the customer.
-
The customer’s users. Our ForceMate Cloud Terms of Service set out account rules and acceptable use. The customer is responsible for its users following them, and users also accept them when they create their account. Accounts are for persons aged 18 or older only. The customer must not invite anyone under 18; athletes under 18 can be registered as athlete profiles without a login.
-
What is included. The features included with your product at the time of purchase, and updates to them, remain available at no recurring cost. We may introduce optional services that carry ongoing operating costs for us, for example high-volume API access or AI-powered features. Such services may be offered and priced separately and are not part of the included service.
-
API. API access is subject to the rate limits and fair-use policy published at ccathletics.com/api-documentation. We may change or introduce such limits to keep the service responsive and its operating costs sustainable.
-
Your data. Data you or your users store in ForceMate Cloud belongs to you. We process personal data in your organisation on your behalf under our data processing agreement (DPA). This applies to every customer, including individual coaches. The DPA covers security, sub-processors, transfers, breach notification, and the return and deletion of data when you stop using the service. You accept the DPA when you create an organisation or place an order that refers to it, or by signing it. It forms part of the agreement between us, and it is available from [email protected].
-
Measurements without the cloud. Measurements can be taken and stored locally in the ForceMate software and exported as Excel or CSV files without using ForceMate Cloud.
-
Availability. We aim to keep ForceMate Cloud available at all times, but we do not guarantee uninterrupted service. We may carry out maintenance, preferably outside normal working hours in Europe.
-
Duration and ending. The service runs for as long as you use it. You can stop using it at any time and ask us to delete your organisation. We may suspend access for a user or an organisation that breaches the Terms of Service or puts the security of the service at risk, and we will tell you why. If we discontinue ForceMate Cloud or a feature included with your product, we will give at least 3 months’ notice.
-
Getting your data out. You can export your data in CSV format in the platform at any time, and for 30 days after the service ends. On request in the same period, we provide a complete export in a commonly used, machine-readable format at no charge. We then delete your data as described in the DPA.
-
Liability. The limitation of liability below also applies to ForceMate Cloud and to our processing of personal data under the DPA.
Shipping & delivery
Where we ship. CC Athletics ships directly to customers within the EU/EEA. In regions served by one of our local distributors, orders are handled by that distributor — you will be directed to the appropriate partner at checkout or on our Distributors page.
Shipping costs. Shipping is calculated at checkout based on the destination, weight, and dimensions of the order, and is shown before you complete your purchase. Unless stated otherwise, shipping costs are paid by the customer. Orders shipped to addresses in Denmark are delivered free of charge.
Processing & delivery times. Orders are dispatched within 2 business days to 6 weeks, depending on stock availability, as also stated in the Purchase agreement above. Where possible, an estimated dispatch or delivery window is shown at checkout or confirmed by email. Delivery times provided are estimates and are not guaranteed; delays caused by carriers, customs, or events outside our reasonable control do not entitle the customer to cancel the order or claim compensation, except where mandatory consumer law provides otherwise.
Delivery terms (Incoterms 2020 — DAP). Unless otherwise agreed in writing, all shipments are made DAP (Delivered at Place), Incoterms® 2020, to the delivery address specified by the customer. This means CC Athletics arranges and pays for carriage to the named destination, while the customer is responsible for import clearance and any import duties and taxes (see “Customs, duties & import taxes” below).
Transfer of risk. Consistent with DAP terms, the risk of loss of or damage to the products remains with CC Athletics during transit and passes to the customer when the goods are placed at the customer’s disposal at the agreed destination, ready for unloading. For consumer (B2C) purchases, the risk passes to you when you, or a third party nominated by you (other than the carrier), take physical possession of the goods, in accordance with mandatory Danish and EU consumer law.
Customs, duties & import taxes. For shipments outside the EU, the customer is the importer of record and is responsible for any customs duties, import VAT, clearance fees, and other charges levied by the destination country. These charges are not included in the product price or shipping cost and are payable by the customer.
Inspection & damaged or lost shipments. Please inspect your order on receipt. If a shipment arrives visibly damaged, or if goods are lost in transit, contact [email protected] as soon as reasonably possible, with your order reference and, where relevant, photos of the packaging and product. We will arrange a replacement, reshipment, or other appropriate remedy. Nothing here limits a consumer’s mandatory statutory rights.
Incorrect or incomplete delivery address. The customer is responsible for providing a complete and correct delivery address. Additional costs arising from an incorrect or incomplete address supplied by the customer (for example, redelivery or return-to-sender fees) may be charged to the customer.
Privacy policy
Please review our Privacy Policy, which also governs your visit to CC Athletics, to understand our practices.
Governing law & jurisdiction
These terms and conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or their formation, are governed by and construed in accordance with the laws of Denmark, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For business (B2B) purchases, the parties agree that the Danish courts shall have exclusive jurisdiction, and that any dispute shall be brought before the City Court of Odense (Retten i Odense) as the court of first instance.
For consumer (B2C) purchases, this choice of court does not deprive you of the protection of mandatory rules of the country in which you reside, and you retain any right you may have under applicable law to bring proceedings in the courts of your own country of residence.
Governing language
These terms and conditions are drafted in English, and the English-language version is the governing and legally binding version. Any translation into another language is provided for convenience only. In the event of any inconsistency, ambiguity, or conflict between the English version and a translated version, the English version shall prevail — except where mandatory law requires that a translated version, or information provided in a particular language, take precedence for that customer (for example, information that must be provided in Danish to a consumer resident in Denmark).
Consumer & business purchases
CC Athletics sells to both consumers (B2C) and businesses / institutions (B2B). Consumer purchases are subject to mandatory consumer protection rights under Danish and EU law, including the Danish Sale of Goods Act (købeloven) and EU distance selling regulations. Nothing in these terms limits or overrides your statutory rights as a consumer. For B2B purchases, the terms stated herein apply as agreed between the parties.
Limitation of liability
This section applies to the fullest extent permitted by applicable law. Nothing in these terms limits or excludes CC Athletics ApS’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under mandatory law. For consumer (B2C) purchases, nothing in this section affects your mandatory statutory rights under Danish and EU law, including the Danish Sale of Goods Act (købeloven).
For business (B2B) customers, the following limitations apply:
- General cap. CC Athletics ApS’s total aggregate liability arising out of or in connection with any order, product or software — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the higher of (a) the total amount paid by the customer to CC Athletics ApS in the 12 months before the event giving rise to the claim and (b) DKK 100,000.
- Data protection cap. CC Athletics ApS’s total aggregate liability arising out of or in connection with ForceMate Cloud or the DPA, including liability for its sub-processors, shall not exceed DKK 250,000 per calendar year. This cap applies instead of the general cap.
- Excluded losses. CC Athletics ApS shall not be liable for any indirect, incidental, special, or consequential loss or damage, nor for any of the following, whether direct or indirect: loss of profits, loss of revenue, loss of anticipated savings, loss of business or business opportunity, business interruption, or loss of goodwill — even if CC Athletics ApS was advised of the possibility of such loss.
- Data and results. We back up ForceMate Cloud as described in our DPA. If data stored in ForceMate Cloud is lost or corrupted due to our fault, we will restore it from our most recent available backup at our own cost. This is your main remedy for loss or corruption of data. Our liability beyond that is limited as set out in this section, and we are not liable for indirect losses resulting from loss of data. You are responsible for backing up data that you store only locally in the ForceMate software. Inaccurate measurement results caused by a defect in the product are handled under the warranty.
- Fines. Administrative fines are borne by the party on which they are imposed.
- Exceptions. The caps and exclusions in this section do not apply to liability for intentional acts or gross negligence, for death or personal injury, or for fraud, or to liability that cannot be limited under mandatory law. They do not limit the rights of data subjects under Article 82 GDPR.
Product liability
Statutory product liability for personal injury and for damage to consumer property applies as provided by the Danish Product Liability Act (produktansvarsloven) and applicable EU law, and nothing in this section limits liability that cannot be limited under those rules. For consumer (B2C) purchases, this section does not reduce your mandatory statutory rights.
For business (B2B) purchases, the following applies:
- Damage to other property. To the fullest extent permitted by law, CC Athletics ApS is not liable for damage caused by a product to real or personal property used in a commercial setting (for example, floors, buildings, fixtures, or other equipment at a clinic, gym, laboratory, or research facility), except where such liability is mandatory under the Danish Product Liability Act.
- Customer indemnity (hold harmless). The business customer shall indemnify, defend, and hold CC Athletics ApS harmless against any claim, liability, cost, or expense (including reasonable legal fees) brought by a third party — including the customer’s own athletes, patients, clients, employees, or other users — arising out of the customer’s use, resale, installation, or operation of the products or software, except to the extent the claim results from CC Athletics ApS’s own gross negligence, wilful misconduct, breach of the DPA or of data protection law, or a defect for which CC Athletics ApS is liable under mandatory product liability law.
- Proper use. This section is conditional on the products being used in accordance with the User Manual and any instructions provided by CC Athletics ApS.
